Terms of Service (writerer)
Last updated: October 3, 2026
Effective: November 1, 2026
If you accept these Terms before November 1, 2026 (for example by creating an account), they apply to you from the day you accept them; for everyone else they take effect on November 1, 2026.
These Terms of Service (the "Terms") are an agreement between you and NerdHonest LLC ("NerdHonest", "we", "us") that governs your use of writerer, including the web app, the Android app, the Windows and Linux desktop apps and their installers, our cloud services, and shared-content pages (together, the "Service"). By creating an account, checking the box or tapping the button that says you agree, or installing, opening, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Summary (Plain English)
This summary is for convenience. The numbered sections below are the binding terms.
- writerer is local-first: your writing is stored on your device first. When you sign in, cloud sync is on by default on every plan, free or paid, and you can turn it off in Settings.
- Your writing is yours. We use it only to run the features you use.
- Paid plans are sold through Stripe. Monthly and annual plans renew automatically until you cancel. You can cancel from Settings → Subscription → Manage Billing or by emailing us.
- If you cancel, Pro lasts until the end of the period you paid for. If you delete your account, we cancel right away and refund the unused part of the period. Lifetime purchases are not refunded, except within 14 days of a first purchase in the EU, EEA, or UK.
- Deleting your account also removes writerer data from the device you delete it on, so export first.
- Beta builds can lose data. Keep backups.
- If you live in the US, disputes go to individual arbitration unless you opt out within 30 days (Section 19).
1. Who We Are
writerer is a local-first writing application for fiction authors. Your writing is stored on your device first. Some features (such as cloud sync, which is on by default when you sign in, share-for-feedback links, and invitations) require an account and an internet connection.
These Terms also serve as the end-user license agreement (EULA) for every build of writerer, including the installers and downloads. There is no separate license agreement.
If you open writing that a writerer user has shared with you (for example as an invited reader or through a share link), these Terms and the Acceptable Use Policy apply to your use of that shared content and of any reader account we create for you.
2. Eligibility
You must be at least 16 years old to use the Service. If you are under the age of majority where you live, you confirm that your parent or legal guardian has reviewed and agreed to these Terms.
If we learn that an account belongs to someone under 16, we may suspend or terminate that account and delete its data.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. Privacy
Our Privacy Policy explains how we handle information when you use writerer. It is available at https://www.writerer.com/privacy and in the app under Settings → Legal.
4. Your Account
Depending on the release or channel you use, you may need to create an account to use the Service (for example during a beta). Some builds may let you use a limited local-only experience without an account. An account is required for paid plans and cloud features.
You agree to give accurate account information, to keep your credentials secure, and to tell us promptly at writerer@nerdhonest.com if you believe someone else has used your account. You are responsible for activity under your account.
5. Plans, Payments, Renewal, and Refunds
5.1 Plans
writerer offers a free plan and paid "Pro" plans. The free plan has limits (for example on the number of projects and idea boards, and on cloud storage). Cloud text sync is included on every plan, including the free plan, and is not removed when a paid plan ends. Pro is offered as a monthly subscription, an annual subscription, or a one-time Lifetime purchase. The current features, limits, and prices of each plan are shown in the app on the Subscription screen (Settings → Subscription) and at checkout. The price shown at checkout before you pay is the price you are charged. Applicable taxes may be added at checkout where required.
5.2 Payment processor
All purchases are processed by Stripe, our payment processor, under Stripe's terms. Purchases are not currently offered through Apple or Google in-app billing. We do not store your full payment card details.
5.3 Automatic renewal and cancellation
MONTHLY AND ANNUAL PLANS RENEW AUTOMATICALLY. WHEN YOU BUY A MONTHLY OR ANNUAL PLAN, YOU AUTHORIZE US (THROUGH STRIPE) TO CHARGE YOUR PAYMENT METHOD THE PLAN'S THEN-CURRENT PRICE AT THE START OF EACH NEW BILLING PERIOD (EVERY MONTH OR EVERY YEAR) UNTIL YOU CANCEL.
You can cancel at any time from Settings → Subscription → Manage Billing (the Stripe billing portal) or by emailing writerer@nerdhonest.com. Cancellation stops future renewals. Unless you delete your account (Section 5.6), your Pro access continues until the end of the period you have already paid for, and the unused part of that period is not refunded except where these Terms or applicable law require it.
If we change the price of a plan, we will tell you at least 30 days before the new price applies to you. The new price applies from your first renewal after that 30-day notice period. If you do not want to pay the new price, cancel before that renewal. Where the law requires a reminder before a subscription renews, we will send one.
If a renewal payment fails, Stripe may retry it. If it still fails, your Pro features may stop and your account returns to the free plan's limits. Cloud text sync of what you already have continues, and nothing is deleted.
5.4 Lifetime purchases
A Lifetime purchase is a one-time payment for writerer's Pro features on your account for as long as we offer the Service. It is personal to your account and cannot be transferred.
Lifetime also includes cloud text sync and 25 GiB of cloud storage (Section 5.5) for as long as we offer the Service, with no renewal or separate sync fee. Because Lifetime already includes everything a Pro subscription does, a Lifetime account cannot also buy a Pro subscription.
5.5 Cloud sync and cloud storage
Cloud sync is on by default when you sign in. You can turn it off in Settings at any time. In current versions of the app, while it is off your writing and images are not uploaded and stay on your device, except share links you create and feedback (with any attachments) you choose to send.
Cloud storage for images and other media files is limited by a quota for your plan: currently 250 MiB on the free plan, 10 GiB on Pro subscriptions, and 25 GiB on Lifetime (purchased or granted). We may show your usage in the app. When you reach your quota, new uploads are refused until you are under it again. Nothing is deleted for being over the quota: if your quota goes down (for example when a subscription ends), files already stored stay stored and downloadable. In current versions of the app, images you add to your projects while cloud sync is off or uploads are refused are kept on your device and uploaded later, once sync is on and you are under your quota. If we offer add-on storage packs, their price, quota, and renewal terms will be shown before you buy, and a pack that renews is a subscription under Section 5.3.
5.6 Refunds
- When you delete your account. If you delete your account while a monthly or annual subscription is active, we cancel it immediately and refund the unused part of the current billing period, pro rata, to your original payment method. If we can't refund to your original payment method (for example because the card has expired), we'll refund you another way; if you have not received it, contact writerer@nerdhonest.com. If we cannot complete the cancellation, your account is not deleted and the app tells you so. See Section 13.
- Lifetime purchases are one-time purchases and are not refunded, including when you delete your account, except under the EU, EEA, and UK first-purchase withdrawal right in Section 5.7 or where applicable law requires a refund.
- Otherwise, payments are non-refundable except as stated in these Terms or required by law.
5.7 Right of withdrawal (EU, EEA, and UK consumers)
If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, you may withdraw from your first purchase of a plan (a new monthly or annual subscription, or a Lifetime purchase) within 14 days of the day you made it, without giving a reason. This right does not apply to renewal payments. To withdraw, tell us within that period with a clear statement that you are withdrawing, for example by emailing writerer@nerdhonest.com. We will refund that payment in full to your original payment method within 14 days of receiving your request, cancel the subscription if there is one, and end the Pro access bought with that payment. If you live elsewhere and your local law gives you a similar right, we will honor it as that law requires.
Nothing in these Terms limits the rights you have under mandatory consumer law, including rights for digital content that is faulty or not as described.
5.8 Promotional and granted access
We may grant Pro access or extra projects through referrals, creator or promotional codes, or beta-tester grants. Each grant lasts for the period shown when it is granted, has no cash value, and cannot be transferred or exchanged. Linking your account with another NerdHonest product does not grant Pro access, extra projects, or any other benefit. We may revoke a grant obtained by fraud, by abuse (for example by creating accounts to collect referral rewards), or in violation of these Terms.
6. License to Use the App (End-User License)
writerer is proprietary software. NerdHonest LLC and its licensors own the app and all rights in it. All rights not expressly granted to you are reserved.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use writerer on devices you own or control, for your own writing projects, including writing you publish or sell.
You may not:
- Copy, sell, rent, lend, sublicense, or redistribute the app or any build or installer of it, except as permitted by law.
- Reverse engineer, decompile, or attempt to extract source code from the Service, except to the extent applicable law expressly permits this despite this restriction.
- Extract, copy, or redistribute any asset bundled with the app (including fonts, sound effects, images, templates, and game-system templates) for use outside the app, or sell or share those assets on their own. This does not restrict the files you create with writerer (for example a PDF or EPUB of your manuscript), which may embed bundled fonts or images as part of your work where those assets' licenses allow.
- Circumvent or disable security features, access controls, plan limits, or Pro gating.
- Use the Service to build a competing product by copying protected elements of it.
Open-source components included in writerer are licensed under their own terms. Where an open-source license gives you rights that conflict with this section, that license controls for that component. Game-system names and other third-party trademarks belong to their owners, and any material we use under an open license (for example a Creative Commons license) remains under that license.
We may release updates. Some updates may be required to keep using cloud features.
7. Your Content and Ownership
7.1 Your ownership
You own the User Content you create in writerer (for example manuscripts, notes, characters, research clips, and comments), subject to any rights of third parties. We do not claim ownership of your User Content.
7.2 Permission you give us to operate cloud features
If you use cloud features (such as sync, which is on by default when you sign in, share links, invitations, external comments, or notifications), you grant us a limited license to host, store, process, transmit, and display your User Content solely to:
- Provide the features you use.
- Maintain and secure the Service.
- Comply with legal obligations.
This license ends when your User Content is deleted from our systems, except where we must retain limited records for legal, security, or backup purposes.
Cloud backups may retain deleted content for up to 90 days after deletion processing, after which the data is permanently removed.
7.3 Sharing, invitations, and readers
You can share your writing for feedback in two ways:
- Anyone with the link. Anyone who has the link may be able to view the shared content and, if you enable it, add comments.
- Invite-only. You enter the email addresses of the people you want to invite. We store those addresses and, unless you choose not to, send each invited person an email from us with the link. To open it, an invited reader enters a one-time code that we email to the invited address; if the reader does not already have a writerer account, sending that code creates a reader account for them. We record when each invited reader last opened the link. When an invited reader comments, you see their name and the email address they were invited with.
You are responsible for choosing what to share and who receives it, and you may invite only people who have agreed to receive an invitation from you. More detail is in the Privacy Policy.
If you are a reader: the shared content belongs to its author, and you may use it only to read it and give the author feedback, within the permissions the author set. You own the comments you write, and you grant the author and us permission to store and display them to the author and to anyone else the author shares the work with. The author can delete your comments. These Terms and the Acceptable Use Policy apply to you; in particular, do not forward invitation links or one-time codes, or let anyone else use your reader account.
7.4 Feedback
If you send us feedback, suggestions, or ideas about writerer (for example through the in-app feedback form), you grant us a perpetual, worldwide, royalty-free license to use them to improve and operate our products, without any obligation to you. This license covers your ideas and suggestions. It does not give us ownership of any User Content that appears in a screenshot or attachment you send, and we use such material only to respond to and resolve your feedback.
8. Acceptable Use
You agree to follow the Acceptable Use Policy, available at https://www.writerer.com/aup and in the app under Settings → Legal. It is incorporated into these Terms by reference.
If you violate the Acceptable Use Policy, we may suspend or terminate your access to cloud features or the Service.
9. Automated Features and Third-Party Integrations
Some features process your text automatically or send it to a third party, but only when you turn them on or use them. Automated suggestions can be wrong; you decide what to accept.
9.1 Grammar and style checking
- LanguageTool (grammar and style checking). It is off by default. If you turn it on, it runs automatically, a short moment after you stop typing, and sends the relevant text from your device to LanguageTool.
- ProWritingAid (fiction-aware style analysis, Pro). It runs only when you choose to check or analyze, and it sends the relevant text from your device to ProWritingAid using the license code you provide.
9.2 Text-to-speech
Read-aloud uses the speech engine of your device's operating system and is available on supported devices (not in the web app). Depending on your operating system and the voice you choose, the operating system's provider may process the text online under its own terms.
9.3 Publishing to platforms you connect
In the desktop and mobile apps, you can connect your own WordPress or Ghost site and publish chapters and images to it, and connect a Discord channel (by webhook) to post release announcements. writerer sends what you choose to publish or announce directly from your device to that platform, using the credentials you provide. Those credentials are stored only on that device and are never sent to our servers, so we cannot publish on your behalf. A scheduled release goes out only if writerer is open on the device that holds the credentials at the scheduled time. You can also record releases you make yourself on other sites.
You are responsible for the content you publish, for having the right to publish it, and for following each platform's terms. Once something is published, removing it is done on that platform. We do not control those platforms and are not responsible for them.
9.4 Research web clipper
writerer can import web pages into your research notes. It fetches the URL you enter directly from your device and extracts the content.
You are responsible for:
- Ensuring you have the right to copy or store the content you clip.
- Complying with the website's terms of use.
- Not using the web clipper for unlawful scraping or circumvention.
10. Third-Party Services
Some parts of the Service rely on third parties (for example Supabase, PowerSync, Stripe, Resend, LanguageTool, ProWritingAid, and the publishing platforms you connect). The Privacy Policy lists the service providers that process personal information for us. Your use of a third-party service may be subject to its own terms and privacy policy.
We are not responsible for third-party services and do not make promises about them. Third parties may change or discontinue their services, which could affect features in writerer.
11. Security and Sharing Risks
11.1 Link risk
"Anyone with the link" share links are bearer-token links: anyone who has the link may be able to access the shared content. Links can be forwarded, guessed if mishandled, or exposed through screenshots, browser history, or device compromise. Invite-only links limit access to the people you invite, but an invited reader can still copy what they can see.
11.2 Revocation and expiration
You can revoke share links and remove invited readers. You may be able to set an expiration time. Revoking a link, removing a reader, or letting a link expire should stop new access, but it cannot delete content a recipient has already copied or cached.
12. Beta Program
While writerer, or a build of it, is offered as a beta, preview, or pre-release version:
- It may contain bugs and may lose or corrupt data. Export your work regularly (for example with Export in each project or folder export) and keep your own backups.
- We make no commitment about uptime, availability, support response times, or how long any build will keep working.
- Features, including paid features, may change, be limited, or be removed.
- If you received Pro access as a beta tester, it ends on June 1, 2027, unless we tell you otherwise in writing. After that, you can subscribe or continue on the free plan, which keeps cloud text sync.
13. Deleting Your Account
You can delete your account in the app under Settings → Account → Delete My Account. We may ask you to confirm the request or sign in again. If you cannot use the app, email writerer@nerdhonest.com from your account email address; we may ask you to verify your identity.
When you delete your account:
- Billing. If you have an active monthly or annual subscription, we cancel it immediately, refund the unused part of the current billing period pro rata, and delete the Stripe customer record when it is linked to your account. The refund goes to your original payment method; if we can't refund it there, we'll refund you another way (contact writerer@nerdhonest.com if you have not received it). Lifetime purchases are not refunded, except as Section 5.6 describes. If the cancellation cannot be completed, your account is not deleted, nothing is removed, and the app tells you so.
- Cloud data. We delete your cloud account data within 30 days. Backups may retain it for up to 90 days. This includes tracked changes (suggested edits) you made in another author's project.
- This device. The writerer data on the device you delete your account from is removed too. Export anything you want to keep first. On any other device where you used the account, remove the app's data there (for example by uninstalling the app).
- Copies we or others keep. Stripe and we keep invoices and payment records where tax or accounting rules require it. An issue in our private issue tracker that contains only a feedback item's id and category may remain. Comments you left as a reader on another author's shared work remain part of that author's project, with your name and, for invite-only links, the invited email address (comments left through an anyone-with-the-link share carry only the name you entered). Your email address also remains on the invitation list of any author who invited you. Content you published to a connected platform, or that recipients copied, is not affected.
The Privacy Policy describes these records in more detail.
14. Termination
You may stop using the Service at any time, and you may delete your account as described in Section 13.
We may suspend or terminate your access to cloud features or the Service if we reasonably believe:
- You violated these Terms or the Acceptable Use Policy.
- You are under 16.
- You are a repeat infringer of others' copyrights (Section 18).
- Your use creates risk or legal exposure for us or others.
- We are required to do so by law.
Termination of cloud access does not prevent you from using offline-only features of the app already installed on your device, unless we terminated your license for a violation of Section 6.
If we decide to discontinue the Service, we will give you reasonable advance notice so you can export your work.
Sections 5.6, 5.7, 6 (ownership and restrictions), 7.3 (comment license), 7.4, 13, and 15 through 24 survive termination.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOUR DATA WILL NOT BE LOST. BETA AND PRE-RELEASE BUILDS (SECTION 12) ARE PROVIDED WITHOUT ANY COMMITMENT OF RELIABILITY.
YOU ARE RESPONSIBLE FOR KEEPING BACKUPS OF YOUR WORK.
WRITERER IS A WRITING TOOL. IT DOES NOT PROVIDE LEGAL, MEDICAL, OR PROFESSIONAL ADVICE.
AUTOMATED SUGGESTIONS (FOR EXAMPLE GRAMMAR AND STYLE SUGGESTIONS) MAY BE INACCURATE OR INCOMPLETE. YOU ARE RESPONSIBLE FOR REVIEWING AND EDITING YOUR WORK.
Some jurisdictions do not allow certain disclaimers. In those jurisdictions, the disclaimers in these Terms apply only to the extent permitted by law. If you are a consumer in the EU, EEA, or UK, nothing in this section affects your statutory rights.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NERDHONEST LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
- USD $100
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow limitations on liability. In those jurisdictions, the limitations apply only to the extent permitted by law.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless NerdHonest LLC from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) brought by third parties and arising out of:
- Your use of the Service.
- Your User Content, including content you share or publish.
- Your violation of these Terms, the Acceptable Use Policy, or applicable law.
18. Copyright and DMCA Policy
We respect copyright and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA) and other applicable law.
18.1 Takedown notices
If you believe content hosted by writerer's cloud features (for example content available through a share link) infringes your copyright, you can send a takedown notice. It should include:
- Your contact information (name, address, phone, email)
- Identification of the copyrighted work you claim is infringed
- Identification of the material you want removed, with information reasonably sufficient for us to locate it (for example the share link URL)
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner's behalf
- Your physical or electronic signature
Send notices to our designated agent:
- Email: dmca@nerdhonest.com
- Address: NerdHonest LLC, Attn: DMCA Agent, 8735 Dunwoody Place, Ste R, Atlanta, GA 30350
Our designated DMCA agent is registered with the U.S. Copyright Office under NerdHonest LLC.
We may remove or disable access to material that is the subject of a notice, and we will make reasonable efforts to tell the user who provided it.
18.2 Counter-notices
If your material was removed or disabled and you believe this was a mistake or misidentification, you can send our designated agent a counter-notice that includes:
- Your name, address, phone number, and email address
- Identification of the material that was removed or disabled and where it appeared before it was removed
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of a mistake or misidentification
- A statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which NerdHonest LLC may be found), and that you will accept service of process from the person who sent the original notice or that person's agent
- Your physical or electronic signature
We will send a copy of a valid counter-notice to the person who sent the original notice. We will restore the material, or stop disabling access to it, no less than 10 and no more than 14 business days after we receive the counter-notice, unless our designated agent first receives notice from that person that they have filed a court action seeking to restrain the alleged infringement.
18.3 Repeat infringers
We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
A notice or counter-notice that knowingly misrepresents facts may expose its sender to liability for damages.
19. Arbitration and Class Action Waiver (US)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO TAKE PART IN A CLASS ACTION.
This Section 19 applies if you live in the United States. If you live elsewhere, it does not apply to you, and Section 20 governs disputes.
Informal resolution first
Before starting arbitration, you agree to contact us at writerer@nerdhonest.com and provide a brief description of the dispute, the relief you want, and your contact information. We will try to resolve the dispute informally. If it is not resolved within 60 days, either party may start arbitration.
Binding arbitration
If we cannot resolve the dispute informally, you and NerdHonest LLC agree to resolve any dispute arising out of or relating to the Service or these Terms through binding individual arbitration, rather than in court, except as described under "Small claims court" and "Exceptions" below.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or by JAMS under its applicable consumer rules if AAA is unavailable. Fees are allocated as those rules provide for consumer disputes. The arbitration will take place in the county where you live or, if you prefer, by video conference, telephone, or written submissions. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Class action waiver
You and NerdHonest LLC agree that disputes will be brought only on an individual basis. You and NerdHonest LLC waive the right to participate in a class action, class arbitration, or representative action. If this class action waiver is found unenforceable for a particular claim, that claim will proceed in court (under Section 20) and not in arbitration.
Mass arbitration
If 25 or more demands for arbitration that raise similar claims are filed against us by or with the help of the same law firm or coordinated group, the demands will be administered in batches of up to 25 (or under the AAA's Mass Arbitration Supplementary Rules, where they apply), and the parties will cooperate in good faith to resolve them efficiently. Fees for each batch will be assessed as if it were a single case to the extent the administrator's rules allow.
Small claims court
Either party may bring an individual claim in small claims court if it qualifies.
Exceptions
Either party may ask a court for an injunction to stop infringement or misuse of its intellectual property.
30-day opt-out
You may opt out of this arbitration agreement by emailing writerer@nerdhonest.com within 30 days after the earlier of (a) the day you first use the Service and (b) the day you create your account. Your email must include your name, the email address used for your account (if any), and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.
If you had an account or used the Service before November 1, 2026, you may also opt out within 30 days after the later of (a) November 1, 2026 and (b) the day we notified you of these Terms, by emailing writerer@nerdhonest.com with the subject "Arbitration opt-out". Your email must include the same information described above.
20. Governing Law and Venue
Except where prohibited by law, these Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. The Federal Arbitration Act governs Section 19.
If a dispute is not subject to arbitration (for example, a small claims matter, a claim excluded from arbitration, or where arbitration is unenforceable), you agree that it will be brought in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction there.
If you are a consumer who lives outside the United States, this choice of law does not deprive you of the protection of the mandatory laws of the country where you live, and you may also bring proceedings in the courts of that country where its law allows.
21. International Use and Export
We offer the Service worldwide. You are responsible for complying with the laws that apply to your use of the Service where you are.
If you are a consumer in the EU, EEA, UK, or another jurisdiction with mandatory consumer protections, nothing in these Terms limits the rights those protections give you.
You may not use the Service if you are located in a country subject to a comprehensive U.S. embargo, or if you are on a U.S. government list of prohibited or restricted parties. You may not export or re-export the app in violation of U.S. export control or sanctions laws.
22. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and notify you in the app or by email. Material changes take effect no earlier than 14 days after we post them and notify you, and the date they take effect is shown as "Effective" at the top of these Terms. Continued use of the Service after that date is acceptance of the changes. We may also ask you to accept the updated Terms. Changes do not apply to disputes that arose before they took effect. If you do not agree to the changes, stop using the Service and you may delete your account. Changes that affect the price of a subscription apply only from the renewal after the notice (Section 5.3).
23. General
- Entire agreement. These Terms, together with the Privacy Policy and the Acceptable Use Policy, are the entire agreement between you and us about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
- Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours, for example in a merger or sale of our business, and these Terms will continue to bind the new owner.
- Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
- Notices. We may send you notices by email to your account address or in the app. You can send notices to the contact details below.
24. Contact
